The sale of Products on the Website is subject to the following General Terms and Conditions of Sale.

The system, which requires active participation from the Customer, has been created in full compliance with distance selling regulations and, in particular, Articles 45 et seq. of the Consumer Code (Legislative Decree No. 206/2005).

  1. INFORMATION FOR THE CONSUMER
    1. The use of the distance-selling service described herein is reserved exclusively for consumers, meaning natural persons acting for purposes not related to any business, commercial, craft or professional activity (“Customers”).
    2. Before confirming and placing a purchase order, the Customer must carefully read these Terms and Conditions of Sale and accept them. These Terms and Conditions of Sale, together with the Privacy Policy, govern the contract between the Customer and Alevì srl with regard to the sale of Products on the Website.
    3. By submitting a purchase order, the Customer accepts and undertakes to comply with these Terms and Conditions of Sale.
  2. ORDER PROCEDURE AND ACCEPTANCE
    1. To purchase one or more Products, the Customer must select the desired items, the color, and the size. The selected Products will be added to the Cart. To retain the items in the Cart for later purchase, the Customer must first create an online account and log in at the time of purchase. It is also possible to complete the purchase without creating an account by following the steps and instructions on the Website, but all items in the Cart will be deleted if the checkout is not completed, and thus will no longer be available for purchase later (requiring the Customer to start a new purchase process when returning to the Website).
    2. Any information entered by the Customer during the purchase procedure can be modified by them until the order is confirmed. Once the order is confirmed and submitted, it can no longer be modified or revoked by the Customer.
    3. The sales procedure is concluded only when the Customer sends the purchase order to Alevì srl. To place the order, the Customer must provide their personal data, including name, address, email address, and payment details. The Customer must also check the relevant box to confirm acceptance of these Terms and Conditions of Sale. Before sending the order, the Customer is invited to carefully review the summary, which includes the Product details, delivery details, the conditions and methods for exercising the right of withdrawal (section 5 below), information on the legal warranty, and the Privacy Policy.
    4. After submitting the order, Alevì srl will send the Customer an email confirming receipt of the order. Customers may access their orders at any time via the “My Account” section or by contacting customer service at: info@alevimilano.com
    5. Order Confirmation does not constitute acceptance of the Customer’s order by Alevì srl. Alevì srl will accept the order by sending a further email confirming that the order has been accepted and that the Products have been shipped (“Shipping Confirmation”). The invoice will be attached to the Shipping Confirmation email.
    6. If the Products ordered are temporarily unavailable (except for limited-availability items whose availability date is explicitly indicated), Alevì srl will inform the Customer within the next working day after submission of the order. If the Products are not available, the Customer’s payment card will not be charged; if already charged, a refund will be made within 14 (fourteen) days via the same card used for the order. If the Customer paid by bank transfer and has already done so, Alevì srl will refund to the same bank account; if the transfer has not yet been made, the order will be canceled and the Customer promptly contacted.
    7. Alevì srl reserves the right, at its sole discretion, not to accept orders if it believes they do not meet the necessary requirements, or if the order is placed by individuals with whom there is an ongoing legal dispute related to a previous order, or for any other reason, without needing to justify this refusal. Alevì srl will notify the Customer of non-acceptance within 30 days from the day after the Customer submitted the order and will refund any amounts already paid. Alevì srl also reserves the right not to accept or fulfill orders that appear to be placed by merchants and/or distributors.
    8. Each Product for sale on the Website is displayed with an image, unit price, available colors and sizes. Images are provided for illustrative purposes only and may not be fully representative of the actual Products, due to browser or monitor settings, graphic or printing errors, or other technical reasons. Alevì srl cannot be held liable for any inadequacy in the visual representation caused by such technical issues. Although the Website is carefully checked, it is possible that incorrect prices may be listed. If the displayed price is lower than the correct selling price, the Customer will be contacted to confirm whether they still wish to buy at the correct price; otherwise, the order cannot be accepted.
  3. PRICES & PAYMENT METHODS
    1. Product prices include VAT but exclude any duties, taxes, or import charges that may apply in the destination country (if different from Italy), which will be borne by the Customer. Delivery costs will be added at checkout. Shipping and any applicable taxes will be detailed on the payment page and in the Order Confirmation.
    2. The price of each Product, expressed in euros (€), is communicated to the Customer before the contract is concluded.
    3. Pursuant to Article 51, paragraph 7 of the Consumer Code, after the contract is concluded, the Customer will receive written confirmation of the ordered Product, its price, the amount paid, information about the right of withdrawal (including timing and methods of return), information on legal and commercial guarantees, and details about out-of-court complaint or dispute resolution mechanisms.
    4. Alevì srl accepts payment by MasterCard, Visa, American Express, and PayPal. For payment, the Customer confirms, via www.alevimilano.com, that they are the cardholder and that the name on the card is theirs; the Customer provides the card number, expiration date, and security code.
    5. For payments via credit card or PayPal, Products will be shipped only after verification of the Customer’s payment details and receipt of authorization from the issuing bank. The verification may take up to 24 hours, though longer delays may occur due to reasons beyond Alevì srl’s control. The Customer’s card will be charged when the order is being prepared for shipment.
    6. If payment fails for any reason, the sale process is automatically canceled.
  4. SHIPPING & DELIVERY
    1. Delivery is made to the address provided by the Customer only once payment has been correctly registered. In accordance with Article 61 of the Consumer Code, Alevì srl will fulfill the order within 30 days of contract conclusion, unless it rejects the order within that timeframe per Article 2.7.
    2. All orders will be delivered by the courier selected by Alevì srl (e.g., TNT, GLS, Mail Boxes, or others) (“Courier”), unless otherwise specified for certain countries, between 9:00 AM and 6:00 PM, Monday to Friday (excluding national or local holidays), after sending the Shipping Confirmation. The Customer will be notified by email of the estimated delivery date and the courier’s contact details. The Customer may contact the courier to arrange a different delivery date.
    3. Standard delivery takes between 4 and 10 business days from the Shipping Confirmation, but this may vary depending on the delivery address and destination country.
    4. Alevì srl is not liable for delays caused by the Courier. The indicated delivery times are approximate and not binding.
  5. RIGHT OF WITHDRAWAL
    1. Alevì srl recognizes that Customers who are not satisfied with the Products received, except in cases provided for by Article 59 of the Consumer Code, may exercise the right of withdrawal granted by Articles 52 to 58 of the Consumer Code. Alevì srl aims to ensure that Customers can exercise this right under favorable conditions.
    2. The Customer may withdraw from the contract within 14 (fourteen) days from receipt of the Product, without providing reasons, by notifying Alevì srl of their decision to withdraw and returning the Product. The right of withdrawal does not apply to custom-made (pre-order) items.
    3. To exercise the right of withdrawal, the Customer must communicate their decision via a statement containing: their intention to withdraw, their personal data, and the details of the Product. A printable withdrawal form is available on www.alevimilano.com in Annex A.

    5. The Customer must return the Product by post or courier within 14 days from notifying Alevì srl. The Product must be sent to:

    1. The Customer bears the cost of return shipping.
    2. Products must be returned via registered and insured mail or courier, in their original packaging (boxes, accessories, tags, protection, etc.), along with the delivery note and a copy of the invoice.
    3. Pursuant to Article 54, paragraph 4 of the Consumer Code, the Customer must provide proof that the right of withdrawal has been exercised within the time limit. The Customer is also responsible for the timely return of the goods.
    4. Upon valid withdrawal, Alevì srl will refund all payments made for the returned Products within 14 days from the date Alevì srl first acknowledges receipt of the returned Products, provided the conditions of point 5.10 are met.
  1. ORDER CONFORMITY
    1. The Customer should inspect the Products upon delivery to ensure they correspond to what was ordered.
    2. Any defects identified at the time of delivery (such as tampering or damage to the packaging, damaged Products, missing items, non-compliant or defective Products — collectively “Defects”) may be noted by the Customer directly with the Courier by adding a written and signed comment on the delivery receipt. In such cases, the Customer may refuse the Products and return them to the Courier.
    3. If Defects are found after delivery, the Customer may return the Products to Alevì srl following the procedure described in section 8.
  2. LEGAL WARRANTY
    1. The Products sold by Alevì srl are covered by a 24-month legal warranty from the date the Customer receives them (“Legal Warranty Period”). This warranty covers any defect or non-compliance. If, during this period, a Product is found to be defective or not conforming (“Defective Product”), the Customer has the right to return it for repair at no additional cost; if a full repair is not feasible, Alevì srl may replace the Product.
    2. To exercise the warranty, the Customer must notify Alevì srl of the defect within 2 (two) months of discovering it. For more information on the consumer legal warranty, please refer to the Consumer Code.
    3. Return of defective Products for repair must follow the return procedure set out in Article 5, where compatible.
  3. LIABILITY
    1. Products on the Website are provided “as is” in terms of availability. Except for the legal warranty, Alevì srl makes no other warranty, whether express or implied, relating to condition, performance, quality or fitness for a particular purpose beyond the Product description included in the order; such warranties are excluded to the maximum extent permitted by law.
    2. Except in cases of willful misconduct or gross negligence, Alevì srl shall not be liable to the Customer for:

– damages or losses caused by the Products (or their use by the Customer), without prejudice to mandatory product-liability provisions;

– damages not resulting from Alevì srl’s breach;

– loss of business or opportunities not caused by Alevì srl’s breach;

    1. No clause in these Terms and Conditions shall limit liability in the case of death or personal injury caused by negligence of Alevì srl, its employees, agents or representatives.
  1. APPLICABLE LAW AND JURISDICTION
    1. This contract is governed by Italian law.
    2. For disputes arising from this contract: if the Customer is a consumer, the court of their place of residence shall have jurisdiction; otherwise, the Court of Rimini shall have exclusive jurisdiction.
    3. If any provision of these Terms and Conditions is found to be invalid, void or unenforceable for any reason, such provision will be severed and will not affect the validity or enforceability of the remaining provisions.
