The offer and sale of products on the Site are governed by the following general terms and conditions of sale (hereinafter, the “General Terms and Conditions of Sale”), in compliance with the laws on distance selling, particularly Articles 45 et seq. of the Italian Consumer Code (Legislative Decree No. 206/2005), as well as the website’s Privacy Policy.
Products purchased on the website (hereinafter, the “Products”) are sold directly by Alevì S.r.l., VAT No. IT04351360401, with registered office in Via Bellaria Nuova, 512, 47030 San Mauro Pascoli (FC), Italy (hereinafter, the “Seller”).
- INFORMATION FOR CONSUMERS
1.1 The distance selling service governed by these General Terms and Conditions of Sale is reserved exclusively for "consumers" as defined in Article 3 of the Consumer Code; “consumers” means natural persons who purchase Products for purposes unrelated to any commercial, entrepreneurial, artisanal or professional activity (hereinafter, the “Customers”). The service is also reserved for people who have reached the age of majority under their country’s laws. The Seller reserves the right not to process orders from individuals who do not qualify as "consumers".
1.2 Delivery is only available in the following countries: United Kingdom, European Union, Australia, New Zealand, Canada, United States, South America, United Arab Emirates, Qatar, Israel, Cyprus, Malta, Hong Kong, Japan, South Korea, Malaysia, Switzerland and Taiwan.
1.3 Before placing an order, the Customer is required to read and expressly accept these General Terms and Conditions of Sale. These General Terms and Conditions of Sale, together with the Privacy Policy, govern the contract between the Customer and Alevì S.r.l. regarding the sale of Products on the Site.
1.4 By submitting an order, the Customer declares to have read, understood, and fully accepted these General Terms and Conditions of Sale and agrees to comply with them.
- ORDER PROCEDURE AND ACCEPTANCE
2.1 To place an order, the Customer must select Products on the website, specifying color and size, following the online instructions. Selected Products will be added to the “Cart”. To save items in the Cart and purchase later, the Customer must create and log in to a personal account. Alternatively, purchases can be made without registering; however, if the process is not completed, items in the Cart will be removed, and the Customer will have to start the process again.
2.2 Any information entered during the purchase process can be modified until the order is confirmed. Once confirmed and submitted, the order cannot be changed or canceled except as provided in Article 5.
2.3 The presentation of Products on the Site does not constitute a purchase offer, but rather an invitation to make an offer. To complete the purchase of one or more Products, the Customer must fill in and submit the online order form, providing complete and accurate personal data and accepting the General Terms and Conditions of Sale by ticking the appropriate box. Before submission, the Customer should carefully review the order summary, including Product details, prices, shipping costs and terms, right of withdrawal information, legal warranty, and Privacy Policy.
2.4 After submitting the order, the Seller will send a confirmation email acknowledging receipt. This is not an order acceptance. Customers can check their order status in the “My Account” section or by contacting: info@alevimilano.com.
2.5 The contract is concluded only when the Seller sends a further email confirming order acceptance and shipping ("Shipping Confirmation"). The invoice will be issued at the same time.
2.6 If the ordered Products are temporarily unavailable (excluding limited availability items explicitly marked on the Site), the Seller will inform the Customer by the next business day. In such case, the order will be canceled:
(i) if payment has not yet been processed, no charge will occur;
(ii) if already charged, the Seller will refund the Customer within 14 days using the same payment method.
2.7 The Seller reserves the right to reject orders not compliant with these General Terms and Conditions or placed by individuals with whom there are ongoing disputes or who appear to be resellers or acting for non-personal purposes. The Seller will notify the Customer of any such refusal within 30 days and refund any payments made.
2.8 Each Product listing includes an image, unit price, available colors and sizes. Product images are for illustrative purposes and may differ slightly from the actual product due to technical factors (e.g., screen settings). Such differences do not affect the Product’s essential features and do not constitute grounds for Seller liability. Despite careful monitoring, typographical errors (including pricing errors) may occur. If the listed price is lower than the actual price, the Seller may contact the Customer to confirm interest in purchasing at the correct price. If the Customer refuses or does not respond, the order will not be accepted.
- PRICES AND PAYMENT METHODS
3.1 Product prices on the Site are in Euro (€) and include VAT. Customs duties, taxes or fees in the destination country (if outside Italy) are not included and are the Customer’s responsibility. Shipping costs are excluded and calculated based on delivery destination and method, and clearly shown at checkout and in the order confirmation.
3.2 In compliance with Article 51(7) of the Consumer Code, after the contract is concluded, the Customer will receive written confirmation with full details including price, delivery terms, withdrawal rights, and warranty/service information.
3.3 Accepted payment methods: debit/credit cards (MasterCard, Visa, American Express) and PayPal. The Customer must guarantee to be the cardholder. Payment data is securely transmitted to the payment provider and is not stored by the Seller. The Seller only uses such data for purchase processing, refunds, fraud prevention, or legal obligations.
3.4 Products will be shipped only after data verification and payment authorization. This process may cause slight delays (usually under 24 hours, but may take longer for reasons beyond the Seller’s control).
3.5 Charges will be applied at the time the order is prepared for shipment. If the charge fails, the sale will be canceled automatically.
3.6 An invoice will be issued for each order and sent to the Customer with the Shipping Confirmation.
- SHIPPING AND DELIVERY
4.1 Products will be delivered only after payment is received. Per Article 61 of the Consumer Code, delivery will occur within 30 days unless otherwise communicated, unless due to force majeure or unforeseen circumstances.
4.2 Delivery will be made by one of Alevì S.r.l.’s selected couriers (e.g., TNT, GLS, MAIL BOXES, or others) Monday through Friday between 9:00 AM and 6:00 PM, excluding national/local holidays. The Customer will receive an email with courier and delivery date information.
4.3 Standard shipping typically takes 4–10 business days from Shipping Confirmation. Timing varies by country.
4.4 The Seller is not responsible for delays caused by the courier or other unforeseen events. Stated delivery times are not binding, though the Seller will make reasonable efforts to comply.
- RIGHT OF WITHDRAWAL
5.1 Customers have the right to withdraw from the contract within 14 days of receiving the Products, without needing to justify. The right of withdrawal does not apply to customised items or other exceptions listed in Article 59 of the Consumer Code.
5.2 To exercise the right, the Customer must notify Alevì S.r.l. with a statement including: withdrawal declaration, Customer details, and item information. Customers may use the form available on the Site or in Attachment A of these Terms.
5.3 The withdrawal notice must be emailed to: online@alevimilano.com
5.4 Within 14 days of the notice, the Customer must return the Products at their own expense to:

5.5 Return shipping costs are borne solely by the Customer.
5.6 Products must be returned undamaged, unused, unwashed, in their original packaging (including boxes, tags, protections, etc.), with the delivery note and a copy of the invoice. Returns must be sent as tracked and insured shipments. Customers are responsible for proper return.
5.7 If the return meets the conditions above, the Seller will refund the Customer within 14 days of receiving the returned Products. Refunds will be made via the same payment method, unless otherwise agreed.
- ORDER CONFORMITY
6.1 Upon delivery, the Customer (or their delegate) must verify that the received Products match the order.
6.2 Any discrepancies—e.g., damaged packaging, missing items, non-conforming or defective Products (“Defects”)—must be immediately reported to the courier with a written and signed note on the delivery document. The Customer may refuse delivery.
6.3 If Defects are identified after delivery, the Customer may return the Products as outlined in Article 7.
- LEGAL WARRANTY
7.1 Products are covered by a 24-month legal warranty from the date of delivery.
7.2 If a Product is found defective during this period, the Customer has the right to free repair or replacement, unless repair is not viable.
7.3 Customers must report any defect within 2 months of discovery to retain the right to warranty.
7.4 The warranty does not cover damage from misuse, negligence, or failure to follow care instructions, nor normal wear and tear.
7.5 Returns under this warranty follow the procedure set in Article 5, where applicable.
- LIABILITY
8.1 Products are sold “as available.” Aside from the legal warranty, Alevì S.r.l. makes no other (express or implied) warranties about performance or suitability beyond what is in the Product description and Order Confirmation.
8.2 Except in cases of fraud or gross negligence, Alevì S.r.l. shall not be liable for:
i. Loss or damage due to improper use of Products;
ii. Damage not directly caused by the Seller;
iii. Indirect or consequential damages (e.g., lost business opportunities).
- APPLICABLE LAW AND JURISDICTION
9.1 These General Terms and any resulting contracts are governed by Italian law. Mandatory consumer protections of the Customer’s country still apply.
9.2 Any disputes will be subject to the exclusive jurisdiction of the Customer’s place of residence or domicile.
9.3 If any provision is deemed invalid or unenforceable, the remainder shall remain in effect unless it negates the contract’s purpose.
9.4 In case of translation into other languages, the Italian version prevails.
